Perfect! Thanks for the info. I'll send him an email. I probably won't hear anything back until next week since it's past COB today, but I'll feel better about my request going to a specific person as opposed to some random bulk mailbox.

As for my calls to them today, I called multiple times and tried various options from the automated menu, but got "Mary" the Gate Keeper every time. She was nice enough, just not as helpful as I'd have liked. I'm sure with all the phone calls from people freaking out because their form wasn't approved instantly and calling for daily status updates on their forms, some filtering is necessary. But it would've been nice to get the email address of my examiner, voicemail, something other than the generic "ask the expert".

Thanks again for the info! I'll be sure and update when this snafu gets resolved.

Don't be surprised. My stamp was approved at like 10pm on a Sunday by Ted.

I'm not much of a football fan (baseball is more my game), but i was surprised the Hawks didn't kick ass and take names. They sure picked one helluva day to play like crap.

That's pretty mixed as far as results. I get a 50/50 results using it. Half of the time within a day or two and the other time no response at all.

I know everything is anecdotal, but I'm curious if, when you used it, it was for general questions or for the actual "Draft" or generally screwed up stamp? I've been lucky and never had any issues with eForms so far, but I've only done a couple.

As Ride said though, emailing Mr. Clutter seems to be the 100% solution from everything I've read.

Well, Ride4frnt was spot on. Mr. Clutter is apparently the man who can get things done. I decided to log in to my eForms account to see if anything had changed, and my form was fixed, with a new approval date of 03-21-15, and was signed by Ted Clutter. Thanks again for the info, Ride!

Filed my first Form 1 for an SBR on 1/28 and it came back approved today 3/24 . And I just went to pick up my new CMT UPH15A lower to match my left hand upper and got delayed by the state aaaaagain .I jotted down the serial # so I can file another form 1 today for this lower . Now if Wa would just allow SBS I could form 1 my Saiga 12 ...........oh first world problems [BD].

Yeah, eFile with a Trust. First one came back in 31 days, last year... this one is at about 68 days. s'ok tho.. haven't figured out the stock I want to use. Thinking MFT Minimalist, but might not be the right one whenI pop the .458Socom upper on!

I don't know the exact dates of submission but I made my purchase from Silencer Shop on May 21. Form 4 has officially been submitted as of 5/29.

I'll be 90 days in on 6/18. Sad thing is I know it's going to bounce, because the dealer left another name on the transfer from a previous deal.

The long waits are somewhat understandable, but it's just outrageous that they don't email error or omission info and let you correct mid-process. Servants of the people, uh huh.

Reminds me of my loan underwriters at work! They will take an entire week to send their decision, only to ask for something easy and then make me resubmit and wait some more. When they easily could have held the file an extra day while I got what was needed.

I have a feeling I am going to see mine out 2nd week of June. I still need mounts and to finish my 300blk build. So have some time I guess

My first can F3'd to LGS in 3 weeks too. Got to fondle it yesterday. The Griffin Recce 7 shipped with a new mini-muzzle brake taper mount not listed when I ordered - single chamber weights only 1.8 ounces! Definitely going to need the blast shield for supers.

So I'm jumping into the NFA game and have a Trust created. I want to SBR an existing lower so can I still file a Form 1 electronically or do I need to submit via paper (thought I read that you can't sumbit anything electronically since the site is down)?

Form1 SBR's are doable via eForms. Just sign up, and fill everything out. There are even a few guides out there to help with the questions. As long as the eform site is up and running, you should be good to go.

That's awesome! I was debating getting a dedicated 9mm can, but the Osprey 45 (and Ti-Rant 45 for that matter) perform so well with sub calibers, i didn't see the point.


I should also mention I'm getting the spec program osprey45. According to my dealer it's got the flag lasered onto it. So I'm excited to see that as well

What you cannot hear in the video, but you COULD in person, was the bullet 'whizzing' thru the air. The damn thing is so quiet you could hear the bullet traveling between point A and B! Not to mention the brass hitting the deck of my boat was louder than the gun.

it won't be up for another 40 minutes, but check this out when it is online. Just a quick video of my setup. What you cannot hear in the video, but you COULD in person, was the bullet 'whizzing' thru the air. The damn thing is so quiet you could hear the bullet traveling between point A and B! The engraving didn't happen unfortunately as originally mentioned, nor did the special box it was supposed to come in. Box doesn't bother me but I was a little bummed that there was no engraving.. Hoever my dealer looked out for me so check back tomorrow once I can Edit the pics.. Ohh and the 147gr rounds though it are awesome!

With my first submission to the ATF is it acceptable to show the lower that I intend on SBR'ing on the Assignment List of my Trust?

This is usually a ford and Chevy debate but IMO wait until it's approved before you add it to the list. The list is for items that are in the trust and yes it will be but like mine I only have NFA items on it once they are approved.

I do not add it to the list until it's approved and all engraving is complete. Just makes sense to not add it until it is 100% legal.

I've heard to keep a list for personal use but send the ATF a blank one each time. Alas, I only have one NFA item so far so it doesn't apply to me, yet.

You have to an item on the list for the Trust to be activated, it doesn't have to your firearm though. I've heard of some putting a dollar bill on the list they submit.

I had a online trust reviewed by my lawyer and he had me put a $20 on the trust before I filed my first form 1. Another trust I have was done directly by a different lawyer, he made no such requests and a suppressor was the first item on that one. Both were adamant about as soon as an item is approved and engraved it needed to be added onto the master list. One actually claimed that having items registered to a specific trust and not listed could cause the trust to be revoked in a court of law. He said 99% of the trust issues he sees are due to poor book keeping.

It really depends on your state and how your trust is written. Nothing in my trust references an assignment sheet, so I haven't sent one in for the last 3 stamps. No issues. But if your trust references one, then it may be required.

I'll have to look at my trust (coyote) but I can tell you with certainty that I did NOT add anything to my list before submitting the form and it was approved no problem.

That's what they had me do too.

I don't know if its for real or not, but they said do it so I did it. It didn't hurt anything and I didn't know any better.

The (well-respected) preparer of mine did the same. But as it turns out, they/he was wrong. Honestly, I think part of the problem is that over the years, there's been different standards applied by the various examiners that even very credible lawyers are giving advice that may have been relevant in the past but may not be true now.

For me, the most simple way to check was to search for the word "assignment" (or "schedule," for those that have that) in my trust. If nothing comes up, you're probably good. But again, I think it depends on your state and how the trust is written.

States have no bearing or control of trusts. They are Federal. And you are confused as Assignment A forms and schedules are two very different things. Assignment A forms are an official part of a trust if it is structured that way and must be kept up to date and submitted in it's most current form every time you submit for a tax stamp. Per the Fed wording that the trust must be submitted complete each time. Without it the trust is incomplete and not valid. Schedules are for private bookkeeping and are not an official part of the trust. They are not required to be submitted and therefore you have the ability to keep non NFA items in the trust private.

And as far as attaching something of value with a serial number to a trust to be valid my lawyer summed it up perfectly. "Do you want your children's lawyer debating in court the necessity of attaching a few bucks to retain possession of a priceless collection?"

States have no bearing or control of trusts. They are Federal.

States do have bearing because what a trust can do according to one state may differ than in another state. A trust isn't drafted by a federal lawyer.


And you are confused as Assignment A forms and schedules are two very different things. Assignment A forms are an official part of a trust if it is structured that way and must be kept up to date and submitted in it's most current form every time you submit for a tax stamp. Per the Fed wording that the trust must be submitted complete each time.

I'm not really confusing them because, as you say, it's IF it's set up that way. Mine has zero mention or reference to either. Some folks only have Schedules, some only Assignments. As an aside, and this is purely anecdotal, but it seems like everyone I've read who posts from TX has a Schedule A.

I have a long short list right now but the 7 is on it [BD]

I just have to prioritize. Maybe an SBR or two then a 7? That's only what? $6000 bucks for everything not including ammo... doable...but I don't want to be in the poor house.

I still need to do my WAR review but my range time has been limited lately and bogged down fine tuning some handloads to a new rifle and an old one I changed the barrel on trying to get things juuuuuust right

Personally when I set mine up I anticipated OR doing what WA did, and while maybe not so I figure I might have less issues with the firearms in a trust and the family being in possession of one of the family guns. I think they said something about exemptions for family loaning and borrowing or whatever, but the ATF can't even figure out decades old law so I don't expect OR to figure out ours any time soon.

Awesome! Congrats! Approval times seem to be all over. I read in a thread on a different site that a Form 4 came back approved in a month. Whether the individual who posted that is full of it or not, who knows. I'm just past the 3 month mark on a few suppressors. Hopefully you'll get yours before the winter sets in.

My recent form 1 was e-filed and took about 4 months. My local guy for cans told me to expect about 5 months on my form 4.

Most of King County should be it's own little state. But then,why the hell should we give it to them? Places already exist where all their wildest gun-free dreams have already come true. Places like Kalifornia,or better yet, The UK or Australia. Buy them all one way tickets and send them to their utopia.

But in the mean time, WA needs to get it's laws fixed. It's completely asinine that you can own and use an SBR that someone else made, but can't make it yourself after jumping through the same hoops as you'd have to jump through to get the one that already made. I hope it gets cleared up sooner than later. Whenever i write letters to elected officials in regards to gun rights, or Second Amendment issues, i always get some canned response about how they respect my Second Amendment rights and are working hard to protect them, blah blah blah, while at the same time calling for more "common sense" gun control laws. How about this for a little common sense: repeal the NFA of 1934 and GCA of 1968, and eliminate the ATF. That's common sense. Not bullshit like universal background checks (because no criminal has EVER bought a firearm illegally) and paying a tax to own something that's guaranteed to you in the Constitution.

Anyway, i'm coming up on 16 weeks since i sent off form 4s for a couple rifle cans, and about 14 weeks on a pistol can. I'd like to think i'm getting close, but it would seem the #@&%ing ATF is dragging ass on processing forms submitted using a trust. @$$holes.

Unlawful firearms—Exceptions.

(1) Except as otherwise provided in this section, it is unlawful for any person to manufacture, own, buy, sell, loan, furnish, transport, or have in possession or under control, any machine gun, short-barreled shotgun, or short-barreled rifle; or any part designed and intended solely and exclusively for use in a machine gun, short-barreled shotgun, or short-barreled rifle, or in converting a weapon into a machine gun, short-barreled shotgun, or short-barreled rifle; or to assemble or repair any machine gun, short-barreled shotgun, or short-barreled rifle.
(2) It is not unlawful for a person to possess, transport, acquire, or transfer a short-barreled rifle that is legally registered and possessed, transported, acquired, or transferred in accordance with federal law.

Looks like by the letter of the law, if you make any repairs to an SBR acquired via Form 4, you're now a felon. It's ridiculous. The wording of the law is contradictory in nature. Section 2 says i can acquire and SBR in accordance with federal law, and filing a Form 1 and making and SBR is definitely in accordance with federal law. But, make and manufacture are the same in the eyes of WA, despite the feds seeing making as one thing and manufacturing as another. But since some uppity clerk at DOL took it upon themselves to call BATFE and tell them the make and manufacture are the same thing in WA, Form 1 is not an option for us right now. Even if Form 1 was allowed, the wording of the law would still make a felon out of anyone who fixed their broken rifle.

The clear intention, and spirit in which the law was passed, was to bring WA state law in to alignment with federal law in regards to SBRs. I believe that's why so many Form 1s were approved for folks in WA prior to the call being made to BATFE. So even though section 2 allows us to have SBRs, it's the language (highlighted in blue) in section 1 that the ATF is using as grounds for denying form 1s. So, the RCW needs to be rewritten, or the AG needs to tell BATFE it's OK for us to make our own SBRs before we will see another SBR form 1 approved.

Complete and total bullshit, yes?

Revised Code of Washington. Other sections of RCW 9.41.190 list further exemptions (LE/MIL in performance of duty, etc.), and grandfather in machine guns, SBS, SBR possessed prior to that section of the RCW going into effect (July of 1994 if memory serves). I'm sure they skirt the Second Amendment the same way places like CA, CT, NY, et. al. do it. And Washington used to be such a nice place to live.

If you were notified by the ATF about a misplaced form, you might just be able to work with your examiner and/or Ted Clutter and resolve the issue. At least on the F1 side, once something is actually looked at and a problem is identified, most of the hard work has already been done and it's just an admin matter for the examiner. There's been lots of examples of "misplaced" or "misfiled" paperwork where the applicant emails Mr. Clutter and the problem is solved in a day or two and the form is emailed/mailed.

Hopefully I'm not giving any false hope!

I went the trust route. It originally was going to be faster, until everyone and their grandma got trusts (who by the way are probably already deaf and don't need one). It's a better option IMHO.

ATF kicked back my Form 4; turns out my Sheriff signed his name and put his agency name (XXXXXX Sheriff's Department) and corresponding address in the CLEO block, but didn't put "Sheriff" as his title and the ATF didn't approve. Here's to a 30 day delay....jerks. New sheriff in office...he didn't know

Well, as luck would have it, the range I use is right on the way to the shop... which means it's on the way BACK with the Salvo as well. Guess a shottie is gonna make the ride with me. I even found some subsonic 12ga ammoto test as well, altho if it cycles my Mossie 930JM remains to be seen. I've been getting some 'tweak' parts so hopefully so. Well, as luck would have it, the range I use is right on the way to the shop... which means it's on the way BACK with the Salvo as well. Guess a shottie is gonna make the ride with me. I even found some subsonic 12ga ammoto test as well, altho if it cycles my Mossie 930JM remains to be seen. I've been getting some 'tweak' parts so hopefully so. But even if not, it'll still be good to see it shoot subs in single shot mode.

You just gotta wait till Sunday!

I've waited longer for less lol. Looking forward to it.

Concerted effort here, too. I'm only 5.5 weeks in and the suck is deafening!!! Help! I need coping mechanisms!

Sorry to hear that.

More reason to go trust/efile. My agent contacted me about a mistake I'd made on the form, and was able to correct it, with my stated prrmission prior to entering it into the submission queue. Otherwise, he told me it would have been kicked back, after the time it takes to get to the pending stage, of course. Good guy points for Mr. Schaible!

Now that just sucks! Why the need for a new check and copy of the trust? Is BATFE denying forms instead of simply sending them back for correction these days? I had a form get kicked back for correction because the caliber box was accidentally left blank, and my dealer corrected the form and returned to BATFE and it was approved and i had my stamp in hand about a week later. At any rate, i can't imagine your frustration. I hope things get sorted out soon!

I think it really depends on who you get as the examiner. Talking with my local SOT, he's had varying different interactions with various examiners, to include such instances where the person forgot to include the trust and was just asked to email it to the ATF. Another story included sending the approved F4 back and asking the someone to sign it before it was issued (due to a forgotten signature)!

It also depends on the error that's on the forum 4. I had a similar issue I called to ask about it. They said if it's my fault I can get it fixed and fast tracked if the ffl makes an error it's a full refile.

I bought my silencers through Rainier Arms. If I'd bought from Silencer Shop or some other place online, I'd still need to have it go through an FFL that deals in NFA goodies, and of course stuff like silencers cost more to transfer because of the paperwork and the FFL storing your item while you wait for your stamp. Plus there's the extra wait time involved with Silencer Shop or whoever waiting for the Form 3 to be approved before they can transfer it to your dealer where you can then start the Form 4 (some dealers will start your Form 4 for you once they have the serial number from whoever you bought the can from, others will make you wait to start the Form 4 until the item is physically in their hands in case they're audited by BATFE). Since I trust Rainier Arms and would've had my item transferred through them anyway, and they had what I wanted in stock, I just bought my silencers direct from Rainier Arms. I think I paid a few bucks more than Silencer Shop's price, but with transfer fees and taxes factored in if I'd bought from a third party, I'm coming out way ahead. If Rainier couldn't get me what I wanted, I'd have no worries dealing with Silencer Shop. But I prefer to buy local if possible and save the time it takes for the Form 3 to clear and the transfer fee in the process.

Yeah, Rainier Arms is local to me. They're awesome to do business with and I've always got a good deal from them (in fact I think they've adjusted their pricing recently to be more competitive with places like Silencer Shop). If there's a problem (rarely happens), or I have a question, I send an email to the guy I usually deal with and he fixes the problem or answers my question. And he's fast abut it too, very proactive. And I trust their competence as a FFL and trust them 100 % to keep my gear safe while I'm waiting for my stamp, which is important because my money is already spent lol. So for me, saving a few bucks isn't worth giving that up. That said, I've heard nothing but good things about Silencer Shop, so if you've got a local FFL who knows his shit that you trust, you shouldn't have any problems. Ultimately, it's your hard earned cash, so roll with whatever makes the most sense financially and that you're comfortable with.

I had a form 4 get returned a couple weeks ago. My newly elected Sheriff didn't put his title "Sheriff" after signing his name and department in the CLEO name and agency space. The ATF apparently wanted to know the title of the Chief LEO at Lexington County Sheriff's Department.... duurrrrrr.....at least they let me "have it corrected" and mail it back in.

None of my local FFLs I deal with regularly are class 3 unfortunately (small farm town), and bigger dealers like Buds or KYGUNCo is quite a drive so it's hard to develop any type of relationship but in passing every few months. I've only been doing promotional and logistical work depending on the season since I graduated college for Criminal Justice, and only part time as of lately. There's only so many positions around the state and the guys who have them usually stay until they retire. I'm just bidding my time until I'm called up to the big leagues lol. Until I'm promoted over to the Conservation officer side of the house and go through Department of Justice training I'm not an LEO nor do I qualify for the same privileges. I can usually conceal carry a firearm depending on what I'm doing or where I'm going, but I do so in a civilian capacity and at my own risk to an extent.

I finished building my 300BLK upper today, and went with a Trifecta RS flash hider instead of the brake that came with the can. No annoying ping! And the mounting system is rock solid and makes one hand on/off easy peasy. So far, i like what i see and find the Silencerco Trifecta mount to be superior to AAC's 51T system. I'll post up some pics in the NFA photo thread soon.

As long as it still says Submitted/In Process when you log in and check the status of your form, you should be good. From what i've read, eForms will immediately put your application in problem status upon submission if you're trying to form 1 SBR an 80% lower, and the model and manufacturer aren't in the ATF database already (or something similar), but that's usually cleared up with an email and some pics of your lower. If your form went submitted/in process immediately and it still shows that, you should be fine. I'm pretty sure the ATF would notify you of any problems with your application, just as they do with paper forms, if a problem is encountered. Just be patient. If it's been six months and nothing has changed, i might call. But eforms are taking just about as long as paper forms for approval again, so it might take 4 months or so. Be sure and log in to check the status of your form. I've read of instances where forms have been approved, and an email stating as much wasn't sent/generated by the system.

As for the date your form was approved, i can only guess that either the ATF or your dealer were sitting on your form before it got sent out or you were notified. When i picked my two cans up last week, my dealer told me that my two Form 4s were sent back with 26 other From 4s from the ATF. Based on that, i'd say it was the ATF that was sitting on your stamp, and that it was sent to your dealer as a batch with some others.

I remember everyone telling me that trusts were way faster when I was setting up my trust. I wonder what percentage are trusts now, and not individual. My latest check was cashed a month after you, so there's a chance of an early Christmas.

Trust... everyone jumped on the trust bandwagon, including myself, last year. The amount of form 1's by individual vs trust is considerably less...

The only reason that I went with the trust is because of the stupid universal background check law that passed in OR. So while not all the firearms will be NFA, all of the firearms will be in the trust. I think then I don't have to worry about the family members in the trust using the firearms.

I called them at 3 months for can 1, and while I had them on the line, they gave me the info for can 2. It took them only seconds to give me the pending date. So I say put your tax stamp dollars to work, and give them a ring. I'll call them next month when it hits three months pending for Mr. Omega.
