Did a search to see if this had been posted, no results, so hopefully it's not a duplicate. I'm posting this not because it is graphic or violent, but because of how quickly a life or death situation can escalate, especially if you have never been in a situation like that before and how quickly you need to react in order to defend yourself.


This happened early 2014; a mentally ill neighbor was threatening other residents, breaking windows, etc, so this resident gets his video camera rolling. He hears commotion in the hallway, peeks out the door and then locks it when his girlfriend protests. He IS armed. Apparently when he opened the door to look, he realized the guy had a machete and had also attracted his attention. The machete wielding man starts to kick through his door and makes it into his home and the homeowner shoots him three times. The falling body knocks the camera off the table, still recording, so there are several minutes of no picture but you can hear the newly shot intruder moaning in pain and the shooter gets sort of emotional in his voice realizing he's probably just killed someone, then neighbors arrive who had been threatened by the intruder and he hardens up. They debate first aid but decide against it due to proximity to intruder and I'm assuming blood, etc "I don't wanna touch him" is heard. Near the end, he tells the homeowner "you've killed me." The homeowner says, "well you were going to kill me," and the intruder says "yeah you damn right I was". Pretty eye opening stuff

The intruder ended up surviving to be charged with several counts of attempted murder, burglary, etc. The bad news is, he was sentenced last week and he only got five definite years in prison, with the potential additional 10 years.

Honestly, I think it's clear based on several indicators (this being one) he never DREAMED he would actually have to shoot someone. Which is unfortunate because he responded armed yet was not prepared to use it, hoping the visual and then verbal escalation would be sufficient. The guy made it several feet in before he caught his first .45ACP sleeping pill. I would have shot through that wet towel of a front door as soon as the foot came through it. He knew the guy was armed, he SAW him attacking a neighbor...you could hear her screaming! I don't know if I could have sat in my place hoping he would go away while he hacked my neighbor up. In fact, I KNOW I would help.

Big props to his own girlfriend though. Dude was bleeding out and gasping like a fish in the living room and not a PEEP. Most women would be screaming/crying/etc. Bet she's seen some shit before that happened.

I also have to say...that guy was dying with ZERO class. Crying, complaining..."you've killed me!"...he sounded like a villain from a made for TV movie.

what prosecutors here in Idaho try to do is plea bargain damn near everything. They avoid jury trials like the plague. The sentencing sounds to me like one of our rather crappy plea bargaining sentences.
